Common Misconceptions

”The AI Act bans or severely restricts most AI applications”

The AI Act prohibits only a narrow category of AI practices deemed to pose unacceptable risks to fundamental rights and democratic values. According to European Commission estimates, over 85% of AI systems currently deployed fall into the minimal-risk category with no specific obligations.

The majority of AI applications remain fully permissible: recommendation systems for e-commerce, AI in video games and entertainment, productivity tools, logistics optimization, marketing analytics, content creation tools, most chatbots (with disclosure requirement), industrial automation, and countless other use cases.

Even within high-risk categories, AI is not banned but regulated. Companies can deploy high-risk AI systems after demonstrating compliance with transparency, accuracy, human oversight, and risk management requirements. These obligations increase development costs and timelines but do not constitute prohibitions.

The truly prohibited practices are specific and targeted: government social scoring systems (à la China’s social credit system), subliminal manipulation causing harm, exploitation of vulnerable groups’ vulnerabilities, real-time remote biometric identification in public spaces by law enforcement (with narrow exceptions), emotion recognition in workplaces and schools.

Example: A retail company deploying AI for inventory management, price optimization, customer service chatbots, and personalized product recommendations faces minimal obligations (chatbot disclosure). Only if implementing AI for hiring decisions (high-risk) would significant compliance requirements apply. The vast majority of the company’s AI use is unrestricted.

The narrative that Europe is “banning AI” or creating innovation-killing regulation misrepresents the Act’s targeted, risk-based approach. However, compliance costs for high-risk systems are real and may disadvantage European startups relative to less-regulated markets, a trade-off reflecting European preference for precautionary approach to technological governance.

”Only companies headquartered in the EU need to comply”

The AI Act has extraterritorial application extending well beyond EU borders. Article 2 establishes that the regulation applies to:

  1. Providers placing AI systems on the EU market, regardless of provider location
  2. Providers and deployers located in EU, regardless of where AI system used
  3. Providers and deployers located outside EU when AI system output used in EU

This means a US company offering AI-based hiring tool to European customers must comply with AI Act requirements. A Chinese company selling AI-powered security cameras to EU businesses falls under the regulation. A UK company (post-Brexit) deploying facial recognition affecting EU persons must comply.

The scope mirrors GDPR’s extraterritorial reach, which established precedent for EU regulations applying globally when affecting EU persons or markets. This is manifestation of the Brussels Effect: EU’s large market (450 million people, over 20% of global GDP) gives it regulatory power beyond its borders.

Enforcement mechanisms:

  • EU can block non-compliant AI systems at border or require withdrawal from market
  • Fines apply based on global turnover (like GDPR), not just EU revenue
  • EU deployers prohibited from using non-compliant AI systems, incentivizing providers to comply
  • Reputational and contractual risks: major EU customers increasingly require AI Act compliance in procurement

Practical implications:

  • US tech companies (Google, Microsoft, Amazon, Meta) establish dedicated EU compliance programs
  • Chinese AI vendors seeking European market must meet EU standards despite different domestic framework
  • Global SaaS providers assess whether worldwide compliance with EU standards is more efficient than regional differentiation

Some smaller non-EU companies may choose to exit EU market if compliance costs exceed revenue potential. This could reduce competition and innovation available to European users, a concern regulators must monitor.

However, for most significant AI providers, EU market access is essential, making compliance non-optional. The Act effectively extends EU governance norms globally through market power.

”The AI Act solves all ethical and safety concerns about AI”

The AI Act addresses important governance gaps but has significant limitations and leaves many AI risks unaddressed or under-regulated.

What the Act does well:

  • Prohibits most egregious rights-violating practices (social scoring, subliminal manipulation)
  • Establishes baseline requirements for transparency, accountability, human oversight in high-risk domains
  • Creates enforcement infrastructure with meaningful penalties
  • Requires some consideration of bias and fundamental rights impacts
  • Regulates general-purpose AI models’ systemic risks to some degree

What the Act doesn’t fully address:

Existential risks from advanced AI: The regulation focuses on near-term, concrete harms to individuals and groups. It does not comprehensively address hypothetical but potentially catastrophic risks from artificial general intelligence (AGI) or superintelligence. While systemic-risk GPAM provisions gesture toward these concerns (model evaluation, adversarial testing), they are not designed for transformative AI scenarios.

Critics from AI safety community argue much stronger measures needed: mandatory safety standards before training large models, international coordination on advanced AI development, potential pause mechanisms. The Act’s provisions are significantly weaker than these recommendations.

Environmental impacts: The Act requires systemic-risk GPAMs to report energy consumption but doesn’t limit it or impose sustainability requirements. Training large language models consumes enormous energy (GPT-3 training estimated at 1,287 MWh; GPT-4 likely multiples higher). Water usage for data center cooling, carbon emissions, and resource extraction for hardware are growing concerns not substantively addressed.

Labor and economic displacement: The Act regulates AI in employment decisions (hiring, firing) but doesn’t address broader economic impacts of automation on employment levels, wage inequality, or worker power. These systemic socioeconomic effects fall outside the regulation’s scope.

Misinformation and societal manipulation: Limited-risk transparency requirements (labeling deepfakes, disclosing AI-generated content) are relatively weak. Sophisticated AI-enabled disinformation campaigns, especially those not involving overtly fake content but rather microtargeted persuasion, may escape meaningful regulation.

Global inequities: The Act doesn’t address use of AI to perpetuate or exacerbate global inequalities, such as AI systems trained predominantly on Western data performing poorly for Global South populations, or extraction of data and resources from developing countries by AI companies based in wealthy nations.

Dual-use and military applications: AI for military purposes largely exempt from the Act. Autonomous weapons systems, AI in warfare, and surveillance technologies used outside civilian contexts face minimal restriction under this framework.

Enforcement challenges: Even well-designed rules require effective enforcement. Given AI systems’ complexity and opacity, verifying compliance is difficult. Authorities need substantial technical expertise, resources, and access to proprietary systems (source code, training data). Whether enforcement will be robust or largely symbolic remains to be seen.

The AI Act is an important step in AI governance, establishing foundations for accountability and rights protection. But it is not comprehensive solution. Complementary efforts needed: international cooperation on advanced AI safety, environmental regulations addressing AI’s carbon footprint, labor policies managing automation’s economic impacts, strengthened democratic resilience against information manipulation, and ongoing evolution of AI governance frameworks as technology develops.

Responsible AI development requires multi-stakeholder efforts beyond regulatory compliance: ethical AI research, corporate responsibility practices, civil society oversight, and democratic deliberation about what kind of AI-enabled future we want to build.
